Acer aspire one netbook battery charge capacity keeps reducing?

my acer aspire one D260 does not charge 100% its capacity keeps reducing. first it was 100% and then the capacity kept dropping bit by by bit so it was like: 100...98...97...and not it only charges to 46% should i get a new battery or is this a software malfunction?
